Terms of Business
The terms the work is done under. Worth reading the cancellation and ownership sections before you commit to anything.
1. Who we are
Pavels Tech Heaven is a sole trader business. When these terms say “we”, “us” or “PTH”, they mean:
Pavels Kozemjakins, trading as Pavels Tech Heaven
34 Hope Street, Inverkeithing, KY11 1LW
pavelstechheaven.com
hello@pavelstechheaven.com
07857 272679
We’re not VAT registered, so the prices we quote are the final amount you pay. There’s no VAT added on top.
2. About these terms
These terms apply to the work we do and the products we supply. They cover:
- Website design and Website Care
- Business IT support, Business Care and Complete
- Cyber Security Reviews and Business Protection Setup
- Google Business Profile Setup
- NFC review cards, stands and the Review Kickstart Bundle
- Home PC repair and computer services
- Any other work we quote for separately
We’ve written them in plain English. If anything isn’t clear, ask us before you go ahead.
Two kinds of customer. Some parts of these terms differ depending on whether you’re buying as a business or as a consumer.
- Business Customer — you’re buying for the purposes of a business, trade, craft or profession. That includes sole traders buying for their business.
- Consumer — you’re buying mainly for yourself rather than for a business.
Where a section applies to only one of you, we say so.
Nothing in these terms affects your statutory rights. If any part of these terms conflicts with rights the law gives you and that you can’t give up, the law wins.
3. How a contract is made
Sending us an enquiry doesn’t create a contract. Our website forms are enquiry forms, not a checkout. Nothing is bought or charged when you submit one.
For services, this is the normal sequence:
- You send an enquiry, or contact us by phone, email or WhatsApp
- We talk about what you need, and confirm the scope, the price and when we could do it
- You accept the quote or the agreed scope
- Payment or an agreed payment arrangement is in place
- Work begins
A contract is formed when you accept our quote or the agreed scope. That can be in writing, by email or message, or clearly agreed in conversation — but for anything other than a small job we’ll confirm it in writing so we both have a record.
For NFC review products, the sequence is:
- You send an enquiry telling us what you’d like
- We confirm the product, the Google review destination it should point to, availability and any configuration details
- We send you a Revolut payment link or an invoice
- You pay
- We configure the product for your agreed destination and test it
- The product comes to you
A contract is formed when you pay. Before that point, either of us can decide not to go ahead.
4. Quotes and scope
What a quote covers. A quote sets out the work we’ve agreed to do and what it costs. Work outside that scope isn’t included.
If more work is needed. If a job turns out to need more than we discussed, we’ll tell you what’s involved and what it would cost, and you decide whether it goes ahead. We don’t do extra chargeable work without agreeing it with you first.
If you change what you want. Changes you ask for after we’ve started can affect the price and the timing. We’ll tell you how before making them.
How long a quote lasts. Unless we say otherwise in the quote, our quotes are valid for 14 days from the date they’re issued. After that, we may need to confirm the price and availability again before you accept.
Fixed prices. Where a service has a published fixed price, that price applies to the scope described for it. Where a price says “from”, the final figure depends on the agreed scope and we’ll confirm it in writing before starting.
Third-party costs. Some work needs software, subscriptions or licences from other companies — business email, booking platforms, password managers, backup services and similar. Those aren’t included in our prices unless we’ve specifically said so. We’ll discuss and confirm anything required before you buy it, and the account stays yours.
Parts and hardware. Where a service says ”+ parts”, the labour price and the parts are separate. Parts are charged at cost plus 15%, and we’ll tell you what’s needed and what it comes to before buying anything.
5. Payment
How you can pay. By bank transfer, in cash, or through a Revolut payment link or invoice.
We don’t take card payments on our website. There’s no checkout on pavelstechheaven.com, and the website never collects or stores your card details. Where you pay by card, that’s handled through Revolut’s own payment tools.
When payment is due. It depends on what you’re buying:
- NFC cards, stands and bundles — paid in full before we configure and supply them
- Smaller fixed-price services — paid in full before work begins
- Websites and larger custom projects — the payment arrangement is set out in your individual quote, so you’ll know it before you accept
- Care Plans — billed monthly, as set out in section 6
We’ll always tell you when payment is due before you commit to anything. We don’t set up automatic card charging, and we don’t take payments you haven’t agreed to.
6. Care Plans
We offer three monthly plans. None of them is required — all our work is available as one-off jobs.
| Website Care | Business Care | Complete | |
|---|---|---|---|
| £49/month | £99/month | £199/month | |
| Covers | Website only | Website + business IT | Website + business IT |
| Included support time | 20 minutes/month, website work | 45 minutes/month, pooled | 90 minutes/month, pooled |
| Response | Within 2 business days | Next business day | Same business day for requests received before 2pm |
| Extra time | £55/hour, half-hour blocks | £55/hour remote | £50/hour remote |
| Onsite rate | Not applicable | £75 first hour, then £55/hour | One requested visit per quarter at £49 first hour, then £55/hour |
How the included time works. On Business Care and Complete, the allowance is one combined pool — website work, IT support and account admin all come out of the same minutes. Unused time doesn’t carry over to the next month.
Website Care covers the website only. It doesn’t cover your computers, devices or business email.
Complete’s quarterly onsite visit. One visit per quarter can be requested at a reduced rate. It isn’t free, isn’t automatic, has to be requested and booked, and doesn’t carry over if unused.
Complete fair use. Priced for up to 10 staff, one site and up to 15 devices.
What “response” means. It means we’ve acknowledged your request and started dealing with it. It doesn’t mean the problem is fixed by then, and it doesn’t mean someone will be on site by then. How long a fix takes depends on what’s wrong.
Availability. You can send us an enquiry or message at any time, day or night. We’re not a continuously staffed 24-hour helpdesk — support work and onsite appointments are arranged directly with you. Plan response times apply on business days.
How billing works. Plans are billed monthly in advance. There’s no minimum term.
If you want to stop. Tell us before your next billing date and there’ll be no further monthly charge. Your plan stays active until the end of your current paid billing period, so you keep what you’ve paid for. There’s no separate notice period to serve and no cancellation fee.
Nothing here affects any statutory rights you have as a Consumer.
What plans don’t include. Third-party software, licences and subscriptions. Hardware and parts. New website pages, redesigns, new functionality, e-commerce product uploads, and SEO or design projects.
7. Website design
What we do. We build the website described in the package or scope you’ve agreed. Starter Website is up to 4 pages with 2 rounds of revisions; Business Website is up to 8 pages with 3 rounds; Custom Website is scoped and quoted individually.
Timing. Starter is 10 working days and Business is 15 working days, counted from when we’ve received everything we need from you — your text, images, prices and details. If content arrives in stages, the timeline moves with it.
What we need from you. Your content, your approvals at the points we ask for them, and confirmation that you have the right to use any material you give us. We rely on that. If material you supply infringes someone else’s rights, that’s your responsibility, and we may need to stop work.
What we don’t promise. We set up the technical foundations properly, but we can’t guarantee search rankings, traffic, enquiries, sales or revenue. Those depend on a great deal outside anyone’s control. We also can’t guarantee that third-party services — booking platforms, email providers, hosting — will always be available or won’t change.
Your domain and accounts. Your domain is registered in your name and stays under your control, along with the business accounts we set up for you.
Your first year. Starter and Business Websites include domain and hosting for the first 12 months.
After the first year, you choose:
- Website Care at £49 a month — hosting, SSL, domain renewal, backups, maintenance and 20 minutes of support each month
- Hosting only at £180 a year — hosting, SSL, backups and required maintenance, with your domain renewal charged separately at cost, and no content changes included
- Take it elsewhere — we transfer your website and domain to any provider you choose, free of charge, once, with no exit fee
We’ll tell you what each would cost for your site before the 12 months are up. Nothing renews without you knowing the price.
Who owns what.
Your materials stay yours. Anything you supply — your logo, your branding, your photos, your text, your existing content — remains yours throughout. Nothing in these terms gives us ownership of it.
Bespoke work becomes yours on full payment. Where we create something specifically for your project — bespoke copy we’ve written for you, custom graphics or logo work, or other deliverables made for your business — ownership passes to you once the project is paid for in full. This is subject to any third-party licence terms that apply to elements within it.
We keep our reusable materials. We retain ownership of the templates, frameworks, generic components and code libraries, internal processes and methods, and any pre-existing or reusable materials we use across projects. That’s how we’re able to build efficiently and price the way we do.
You can use your website however you like. You have permanent rights to use, modify and transfer the finished website. That includes moving it to another provider or another developer — which is exactly why the free transfer out in the section above is a real option and not a formality.
Third-party assets. Some elements of a website may be licensed rather than owned — fonts, plugins, stock images, software. Those remain subject to their own licence terms, which travel with them. We’ll tell you where that applies to your site.
8. IT support and computer services
What we need from you.
- Back up anything important before we work on a machine, wherever that’s practical. If you’re not sure whether you have a usable backup, tell us when you get in touch.
- Tell us about faults you already know about, and anything else relevant — previous repairs, existing problems, unusual software.
- Give us lawful access and permission for any equipment or accounts we need to work on.
Diagnosis. The £25 PC Diagnosis is an assessment and a quote. It isn’t a repair, and it doesn’t guarantee that every fault will be identified. Some faults can’t be traced, and some machines aren’t worth repairing — if that’s the case we’ll tell you.
Your data. We take care with information on machines we work on. But depending on what’s wrong with a device, files can’t always be preserved or recovered — that’s why the backup above matters.
We’re responsible for our own work. If we cause loss or damage through failing to use reasonable care and skill, we don’t try to escape that. What we can’t accept responsibility for is loss that was already inevitable because of the state of a device, or because important data existed in only one place despite us asking you to back it up.
Please don’t send us credentials. We don’t ask for passwords, PINs, recovery codes or security keys through our forms, by email or by message, and we don’t need them to answer an enquiry. Where access is genuinely required for a piece of work, we’ll agree an appropriate method with you at the time — we’d rather you didn’t share passwords at all where there’s a better way.
9. Cyber security services
What the Business Security Review is. A practical review of how your business accounts, data and devices are organised, with a plain-English written report and a prioritised action plan. Suitable for businesses of roughly up to 10 staff.
What it isn’t. It isn’t a penetration test, a formal vulnerability assessment, Cyber Essentials certification, an ISO audit, or a legal or GDPR compliance audit. It isn’t legal advice. If you need any of those, you need a specialist provider or a certification body, and we’ll say so.
What Business Protection Setup is. Our professional fee for configuring agreed improvements — priced for up to 10 staff and up to 15 devices. The £199 covers our time and expertise, not software. Password manager, backup and similar subscriptions are separate, and we’ll confirm what’s needed before you buy anything.
The review credit. If you have the £149 review and go ahead with Protection Setup within 60 days, the £149 comes off the £199.
Qualifications. Pavels holds a BSc (Hons) in Cyber Security and Forensics. That’s an academic qualification, not a professional certification or an accreditation from any regulator, and our services are scoped accordingly.
What we can’t promise. No security work eliminates risk. We can’t guarantee that an incident will never happen. What these services do is improve the practical controls covered by them and give you a clearer, better-organised setup.
10. Google Business Profile and review products
Google Business Profile Setup. We help get your listing’s core business information organised. Google controls verification, approval and whether a profile is eligible at all — those decisions are Google’s and we can’t guarantee the outcome.
NFC review products. Cards and stands are a one-off purchase. There’s no subscription.
One product, one destination. Each card or stand is configured for one agreed Google review destination. It doesn’t switch between several. If you have more than one location or Google Business Profile, additional products are scoped separately.
If your review destination changes later. If your Google review destination changes — for example if your listing is recreated or your business details change — reconfiguration may be available and will be quoted separately at the time. Get in touch and we’ll tell you what’s possible for your particular product.
Before supply. Each unit is configured for your agreed destination and tested.
How we do reviews. Every customer who uses the product gets the same route to the same public Google review page. We don’t set up filtering or gating, we don’t write or sell reviews, and we don’t build incentives into review requests.
What we can’t promise. The products remove steps between a customer and your review page. We can’t guarantee you’ll receive any particular number of reviews, any particular rating, or any improvement in how you appear on Google.
11. Delivery of physical products
How products reach you. By local hand-delivery where practical, or by post. We’ll confirm the arrangement with you when we confirm your order.
Risk and ownership. Goods become your responsibility once they’re delivered to you or to someone you’ve asked us to deliver to.
If something arrives faulty, damaged or isn’t what was agreed, tell us and we’ll put it right. Your legal rights over faulty or misdescribed goods aren’t affected by anything in these terms.
12. If you’re a Consumer — your cancellation rights
This section applies to Consumers only.
When these rights apply. Where we agree work or a sale entirely at a distance — by website enquiry, email, phone or WhatsApp — or away from our business premises, you’ll usually have 14 days to change your mind, starting from when the contract is made for services, or from when you receive the goods for products.
Some situations are different. A small number of contracts fall outside these rules, and where that applies to something you’re buying, we’ll tell you before you commit.
How to cancel. Just tell us — email hello@pavelstechheaven.com or call 07857 272679. You don’t need to give a reason or use a particular form of words.
If you want us to start during the 14 days. Sometimes you’ll want work to begin straight away rather than waiting. If you ask us to start during the cancellation period, we’ll ask you to confirm that expressly, and we’ll acknowledge it in writing.
If you then cancel part-way through, you pay a fair proportion of the price for the work we’ve properly done up to that point — not the whole amount, and not nothing.
If a service is fully completed during the 14 days at your express request, and you acknowledged that you’d lose the right to cancel once it was finished, the cancellation right no longer applies to that completed service. We’ll make that clear at the time rather than afterwards.
Returning goods. If you cancel a product order, send the goods back or let us collect them. We’ll refund you, including standard delivery costs where they apply, once we’ve received them or you’ve shown they’ve been sent.
Custom and personalised products. The Premium Custom Branded Stand is produced with your own branding and to your specification. Where a product is genuinely made to your specification or clearly personalised for you, the statutory 14-day change-of-mind cancellation right doesn’t apply, because of the nature of the goods themselves.
Whether that applies depends on the particular product and what’s actually being made for you. If it applies to something you’re ordering, we’ll tell you clearly before the contract is made — not afterwards — so you know where you stand before you commit.
This exception is narrow. Ordinary NFC cards and stands don’t become personalised goods simply because we configure their NFC or QR destination to point at your Google review page. Configuring a destination isn’t the same as making something to your specification.
It also never affects your rights over goods that are faulty, damaged, not as described or otherwise don’t conform to the contract. Those rights apply to personalised products exactly as they do to anything else.
13. If you’re a Consumer — your other rights
Nothing in these terms takes away or limits rights the law gives you.
Services. We must carry out services with reasonable care and skill, within a reasonable time where no time was agreed, and for a reasonable price where no price was agreed. If we don’t, you’re entitled to have things put right, or to a price reduction where that isn’t possible or reasonable.
Goods. Products we supply must be of satisfactory quality, fit for purpose and as described. If they aren’t, you may be entitled to a repair, replacement or refund depending on the circumstances and how long you’ve had them.
We won’t ask you to give up these rights, and if anything in these terms appears to do so, that part doesn’t apply.
14. Third-party services
We often help with services provided by other companies — Google, Microsoft, domain and hosting providers, device manufacturers, software vendors and others.
We don’t control those platforms. We can’t guarantee their availability, their pricing, their policies, their verification decisions, or that they won’t change how they work. Where a third-party service is needed, you hold the account and pay the provider.
This doesn’t reduce our responsibility for our own work. If we set something up badly, that’s on us.
15. Confidentiality and personal information
Personal information. How we handle it is set out in our Privacy Policy — please read that alongside these terms.
Business information. Where either of us shares non-public business information with the other in the course of the work, we’ll each keep it confidential and use it only for the purpose it was shared for. That doesn’t apply to information that’s already public, that either of us already knew, or that we’re required by law to disclose.
16. Our responsibility to you
We don’t limit or exclude liability where the law doesn’t allow it. That includes death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and any statutory rights you have as a Consumer that can’t be excluded.
What we’re responsible for. If we fail to use reasonable care and skill and that causes you loss or damage, we’re responsible for loss that’s a foreseeable result of what went wrong.
What we’re not responsible for.
- Loss that wasn’t foreseeable when the contract was made
- Problems caused by information or materials you gave us being inaccurate, incomplete or unlawful
- Failures of third-party platforms and services we don’t control
- Outcomes we’ve expressly not promised — search rankings, review numbers, sales, or freedom from every security incident
If you’re a Business Customer. We’re not responsible for loss of profit, loss of business, loss of anticipated savings, or loss of business opportunity or goodwill.
Our maximum liability to a Business Customer for any claim is limited to the amount you paid us for the specific job or contract that gave rise to it. This doesn’t apply to any liability that can’t legally be limited — including death or personal injury caused by our negligence, and fraud or fraudulent misrepresentation.
If you’re a Consumer, we don’t limit our liability for losses arising from our failure to use reasonable care and skill beyond what the law permits. We do not supply products or services for commercial use by Consumers, and if you use them for a business purpose you’re a Business Customer for the purposes of these terms.
17. Delays and things outside our control
Sometimes things happen that neither of us can control — supplier problems, third-party outages, parts we can’t get, illness, or other events genuinely beyond reasonable control.
If that happens, we’ll tell you as soon as we can and agree a revised timescale. We won’t be responsible for delay caused that way, but we also won’t simply keep money for work we haven’t done. If a delay makes the work pointless for you, you can cancel and we’ll refund anything you’ve paid for work not yet carried out.
If the delay is on your side — content not supplied, access not available, approvals not given — the timeline moves accordingly, and we’ll tell you where things stand.
18. Ending the work
If you want to stop. Consumers have the cancellation rights in section 12. Beyond that, either of us can end an arrangement by telling the other. You pay for work properly carried out up to that point, and for any parts or third-party costs already committed on your behalf with your agreement.
If we need to stop. We may end an arrangement if:
- An invoice remains unpaid after we’ve asked you to settle it
- We’re asked to do something unlawful, or something we reasonably believe would be
- We’re subjected to abusive or threatening behaviour
- We genuinely can’t proceed — for example because access, content or information we need isn’t provided despite asking
Either way, we’ll hand over any of your own materials we hold, and confirm the position on any domain, accounts or website work covered by section 7.
We don’t charge cancellation penalties. You pay for what’s been done, not a fee for stopping.
19. Complaints
If something’s gone wrong, tell us first — we’d rather fix it than have you unhappy.
hello@pavelstechheaven.com · 07857 272679
We’ll acknowledge your complaint, look into it, and come back to you with what we propose to do. If we can’t put it right ourselves, we’ll say so plainly rather than leaving it hanging.
20. General
Changes to these terms. We may update them from time to time. The version that applies to your work is the one in force when your contract was made.
If part of these terms doesn’t apply. If any part turns out to be unenforceable, the rest still stands.
Transferring the contract. You can’t transfer your rights under these terms to someone else without our agreement.
21. Law and where disputes are dealt with
Pavels Tech Heaven is based in Scotland, and these terms are governed by the law of Scotland.
If you’re a Consumer, this doesn’t take away the protection you have under the law of the part of the UK where you live. You can bring proceedings in the courts of the part of the UK where you’re based, and we’ll only bring proceedings against you there.
If you’re a Business Customer, the courts of Scotland have jurisdiction.
